Collections Law

Obtaining a judgment is rarely the end of the legal process. Once you obtain a judgment against a Defendant, you then must determine how to turn that paper judgment into money. The process of post-judgment collections can be a daunting and confusing task. The Larkin Law Firm has many years of experience in post-judgment collections, and we can assist you with getting you paid. We understand the statutory limitations of debtor protections under Texas law, such as the Homestead exemption, and we offer personalized fee arrangements to help you collect on your judgment in an affordable manner.

Enforcing Out of State Judgment in Texas

Post-judgment collection is especially difficult when the property of the judgment debtor is located in another state. The federal Constitution provides that a judgment from a sister state (of the United States) is entitled to the same “full faith and credit” in every court within the United States. However, procedurally, a foreign or “sister state” judgment cannot be enforced in Texas until it is registered or “domesticated” in Texas as a Texas judgment. Through the use of the Uniform Enforcement of Foreign Judgments Act, The Larkin Law Firm can help you enforce out-of-state judgments using the Texas judicial process. Once the judgment is domesticated, we can help you pursue all applicable collection remedies in order to collect on your judgment.
